Is Your Email Marketing CAN-SPAM Compliant?

Building your email list organically can be a slow process, and it can be tempting to look for ways to quickly grow contacts by purchasing lists. The problem? Sending unsolicited emails can put you on the wrong side of the law. The 2003 CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography and Marketing) introduced regulations that email marketers must abide by in an attempt to crack down on the growing problem of spam. Every violation carries a hefty fine of $16,000 per email.

To ensure your marketing emails comply with the law, make sure you’re doing these six things:

1. Have Your Company Name Stand Out

Your company’s information must be included in “from” fields so that readers know who they are opening an email from. If you send emails from an employee's name, find a way to include the name of your business in the domain.

2. Include Your Contact Information

The physical location of your company and relevant contact information has to be in every email you send. This helps verify to readers that your business is legitimate.

3. Make It Easy to Unsubscribe
Subscribers must be able to easily opt-out of your subscriber list if they want. All emails must have a clear way to unsubscribe – usually included at the bottom – and you have to be sure that they are removed from lists within ten business days.

4. Create Relevant Subject Lines

What you say in the subject lines of your emails must correlate with what is in your messages. You want readers to know exactly what to expect when opening your emails. Be aware of words or phrases that are likely to trigger spam filters.

5. Ads Need to Be Crystal Clear

If you are using email to advertise a product or service, your promotions must be easy to understand. You can't include fine print that contradicts what you’ve promised in your subject line and/or email body.

6. Monitor Any Outside Partners

If you use an agency for your email marketing, you must always make sure the emails they send are compliant with anti-spam laws, as you will be held responsible for any and all violations. Take the time to inquire about your marketing partners’ spam-navigating strategies.
